Terms of Service

Accounts and Eligibility

You must be at least 18 years old and able to form a binding contract to use DeliveryTower. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate account information and promptly notify us of unauthorized use or security concerns.

Use of the Service

DeliveryTower helps teams assess, prioritize, route, and learn from software delivery work. You may use the service only in compliance with these terms, applicable laws, and any documentation or usage limits we provide. You are responsible for the content, data, and integrations you submit or connect to DeliveryTower.

You will not misuse the service, interfere with its operation, attempt to access systems or data without authorization, reverse engineer the service except where legally permitted, transmit malicious code, use the service to violate third-party rights, or use DeliveryTower for unlawful, harmful, or abusive activity.

Customer Data and Integrations

You retain ownership of content and data you submit to DeliveryTower. You grant us the rights needed to host, process, transmit, display, and use that data to provide, secure, support, and improve the service. If you connect third-party services, you authorize us to access and process data from those services as needed for the features you enable.

You represent that you have the rights and permissions necessary to submit customer data and connect third-party integrations. Your use of third-party services remains subject to their own terms and policies.

AI Features and Product Outputs

DeliveryTower may provide AI-assisted assessments, recommendations, summaries, classifications, analytics, and other outputs. Outputs may be incomplete, inaccurate, or unsuitable for a particular purpose. You are responsible for reviewing outputs and making your own business, technical, security, legal, and compliance decisions.

Fees and Subscriptions

Some features may require paid subscriptions or usage-based fees. If you purchase paid services, you agree to pay applicable fees, taxes, and charges according to the order, checkout flow, invoice, or written agreement. Fees are non-refundable except as required by law or expressly stated in writing.

Intellectual Property

DeliveryTower, including its software, design, interfaces, workflows, documentation, trademarks, and other materials, is owned by Focused Objective LLCor its licensors. Except for the limited right to use the service under these terms, no rights are transferred to you.

Confidentiality

If either party receives non-public information from the other that should reasonably be understood as confidential, the receiving party will use reasonable care to protect it and will use it only for purposes related to the service, unless disclosure is required by law.

Suspension and Termination

You may stop using DeliveryTower at any time. We may suspend or terminate access if you violate these terms, create risk for the service or other users, fail to pay amounts owed, or if continued access would expose us or others to legal or security risk. Upon termination, your right to use the service ends.

Disclaimers

DeliveryTower is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, Focused Objective LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities. Our total liability for claims relating to the service will not exceed the amounts you paid to us for the service in the 12 months before the event giving rise to the claim, or $100 if no amounts were paid.

Indemnity

You agree to defend and indemnify Focused Objective LLC from claims, damages, liabilities, costs, and expenses arising from your customer data, your use of DeliveryTower, your integrations, your violation of these terms, or your violation of law or third-party rights.

Governing Law

These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. The courts located in King County, Washington will have exclusive jurisdiction over disputes, except where applicable law requires otherwise.

Changes

We may update these terms from time to time. Material changes will be posted with a new effective date or otherwise communicated as required by law. Continued use of DeliveryTower after changes become effective means you accept the updated terms.
